1. Agreement to Terms

By accessing or using PigeonMailer's services, website, or API (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

PigeonMailer is a product of Guava Trees Softech Pvt Ltd ("Company," "we," "our," or "us").

2. Description of Services

PigeonMailer provides a multi-channel notification platform that enables you to send notifications via Email, SMS, WhatsApp, Slack, and Push notifications through a unified API. Our Services include:

  • Notification delivery across multiple channels
  • AI-powered send-time optimization
  • Template management and analytics
  • API access and SDKs
  • Dashboard and reporting tools

3. Account Registration

To use our Services, you must:

  • Create an account with accurate and complete information
  • Be at least 18 years old or have legal capacity to enter contracts
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access

You are responsible for all activities that occur under your account.

4. Acceptable Use Policy

You agree NOT to use our Services to:

  • Send spam, unsolicited messages, or violate anti-spam laws (CAN-SPAM, GDPR, etc.)
  • Send content that is illegal, harmful, threatening, abusive, or harassing
  • Impersonate any person or entity
  • Transmit malware, viruses, or malicious code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our Services
  • Violate any applicable laws or regulations
  • Send notifications without proper recipient consent

Violation of this policy may result in immediate suspension or termination of your account.

5. Payment Terms

Billing

  • Paid plans are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as stated in our refund policy
  • Prices may change with 30 days' notice

Overages

If you exceed your plan's notification limit, you may be charged overage fees or your notifications may be paused, depending on your plan.

Refund Policy

We offer a 14-day money-back guarantee on paid plans. To request a refund, contact us within 14 days of your initial purchase.

6. Service Level Agreement

For paid plans, we commit to:

  • Starter: No SLA
  • Growth: 99.9% uptime
  • Enterprise: Up to 99.99% uptime with custom terms

SLA credits may be issued for qualifying downtime. Enterprise customers receive detailed SLA terms in their service agreement.

7. Intellectual Property

Our Property

PigeonMailer and its associated logos, designs, and content are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.

Your Content

You retain ownership of your content (templates, recipient data, etc.). By using our Services, you grant us a license to process your content solely to provide the Services.

8. Data Processing

Our handling of personal data is governed by our Privacy Policy. For business customers processing personal data of EU residents, we offer a Data Processing Agreement (DPA) upon request.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIGEONMAILER SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding the amount paid by you in the 12 months preceding the claim

These limitations apply regardless of the theory of liability.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free service.

11. Indemnification

You agree to indemnify and hold harmless PigeonMailer and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

12. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the Services will be revoked
  • We may delete your data after a reasonable retention period
  • Accrued rights and obligations survive termination

13. Modifications to Terms

We may modify these Terms at any time. Material changes will be notified via email or through the Services. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of India, and you consent to personal jurisdiction in such courts.

15. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and PigeonMailer.
  • Severability: If any provision is found invalid, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any right does not constitute a waiver.
  • Assignment: You may not assign these Terms without our consent.
